1. Purpose
These General Terms and Conditions of Sale (GTC) govern sales made on the www.arcance.fr website, operated by FLAURELYS under the trade name ARCANCE. They define the respective rights and obligations of the seller and the buyer in the context of online sales of home decoration products. Any order placed on the website implies full and complete acceptance of these terms and conditions.
2. Products
The products offered for sale are described and presented with the greatest possible accuracy. However, photographs and descriptions are not contractual and may show slight variations. ARCANCE cannot be held responsible for any minor differences between the product delivered and that presented on the website.
3. Prices
Prices are indicated in euros (€), all taxes included (TTC). As FLAURELYS is a VAT-exempt micro-enterprise, VAT is not applicable according to article 293 B of the French Tax Code (CGI). ARCANCE reserves the right to modify its prices at any time, but products are invoiced based on the rates in force at the time the order is confirmed.
4. Order
Any order implies acceptance of the prices and descriptions of the products available for sale. The customer receives a confirmation email once the order is validated. ARCANCE reserves the right to refuse any order from a customer with whom there is a dispute regarding the payment of a previous order.
5. Payment
Payments are made via the secure methods offered on the online store (credit card or other available solution). Full payment is required at the time of order. Transactions are secured and encrypted in accordance with current standards.
6. Delivery
Products are shipped from our partner warehouses. Delivery is free, with no minimum purchase, in mainland France, Corsica, French overseas departments and territories (DOM-TOM), and the European Union.
Estimated delivery times are as follows:
- Mainland France: 3 to 7 working days
- European Union: 5 to 14 working days
- DOM-TOM: 7 to 21 working days
These deadlines are indicative. ARCANCE cannot be held responsible for delays attributable to carriers or any event beyond its control.
7. Withdrawal and returns
In accordance with article L.221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal. All return requests must be submitted via our contact form on arcance.fr.
Products must be returned in their original, unused condition and in their complete packaging. Return shipping costs are at the customer's expense. A restocking fee of 15% of the item's amount will be deducted from the refund. The refund will be processed within 14 days of receipt and inspection of the return.
8. Legal guarantees
Products benefit from legal guarantees of conformity (articles L.217-4 et seq. of the French Consumer Code) and against hidden defects (articles 1641 et seq. of the French Civil Code). Any complaint must be submitted via our contact form on arcance.fr.
9. Liability
ARCANCE cannot be held responsible for delays or delivery errors beyond its control, nor for the indirect consequences of inappropriate use of products. In any event, ARCANCE's liability shall not exceed the total amount of the order concerned.
10. Intellectual property
All elements of the www.arcance.fr website (texts, images, logos, graphics, layout) are the exclusive property of FLAURELYS / ARCANCE or their partners. Any unauthorized reproduction or use is strictly prohibited and would constitute an infringement punishable by the French Intellectual Property Code.
11. Personal data
Collected data is processed in accordance with the GDPR. It is used solely for order processing and commercial communication (with consent), and is never resold. The customer has the right to access, rectify, and delete their data by contacting us via our contact form on arcance.fr.
12. Disputes
These GTC are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, French courts will have sole jurisdiction.
